This agreement for receiving a FreeNetPass password between you ("Surfer") and NetPass Systems Inc. ("FreeNetPass") is effective upon your acceptance until revoked by either party.

In consideration for being issued a FreeNetPass password, Surfer acknowledges and agrees that all statements of fact set forth herein are true and correct, and that Surfer’s use of the FreeNetPass password will at all times comply with the terms and conditions set forth below, including any changes or amendments made by FreeNetPass.

Surfer agrees that any passwords obtained from FreeNetPass are for the sole use of the surfer and is not to be distributed in any way. Distribution will lead to cancellation of service and legal action where necessary.

Surfer agrees that in obtaining a FreeNetPass Free password, surfer is also receiving free trial access to Sexuncensored.com, RawMen.com, or XXXAmatuerErotica.com for the listed term. After which time the subscription will renew at the listed rates for Sexuncensored.com, RawMen.com, or XXXAmatuerErotica.com at the time of signup (unless cancelled within the trial period) in accordance with the terms agreed to at the time of signup. Surfer agrees to follow the terms and conditions of the billing company and Sexuncensored.com, RawMen.com, or XXXAmatuerErotica.com site.  Surfer acknowledges that Sexuncensored.com, RawMen.com, and XXXAmatuerErotica.com are not owned or operated by FreeNetPass and FreeNetPass has no control over site content and billing practices.  Surfer agrees to contact the billing company with all billing issues that may arise from surfers subscription to Sexuncensored.com, RawMen.com, or XXXAmatuerErotica.com.  The FreeNetPass Free password is valid for one year and allows access to all FreeNetPass Free web pages without charge and is yours to keep regardless of membership status at Sexuncensored.com, RawMen.com, or XXXAmatuerErotica.com.  Billing services are provided by .  Alternatively to receive your FreeNetPass Free password: Please send a self-addressed, stamped envelope along with a copy of your US Drivers license or Passport to: Membership Dept., NetPass Systems Inc., 7900 International Dr. Suite 685, Bloomington, MN 55425 USA.  Your username and password will be sent to the address on your ID (we cannot send to any other address). Please allow 8-10 weeks for processing.

Surfer agrees that in obtaining a FreeNetPass Premium password, they agree to pay in full, the amount listed at the time of signup for the membership option chosen (currently $24.95 per 1 month membership or $64.95 per 3 month membership.  The FreeNetPass Premium password subscription will automatically renew at the end of the initial membership term on a monthly basis at a cost of $24.95 per month (unless the membership is cancelled prior to the end of the current billing cycle).  Billing services for FreeNetPass Premium are provided by ccbill.com or .

After 1 year, all Free passwords will automatically be cancelled.  At that time, you will be offered the option to purchase a 1 year FreeNetPass Annual subscription.  Surfer agrees that in obtaining a FreeNetPass Annual password, they agree to pay in full, the amount listed at the time of signup (currently $29.95 per year membership).  This password will automatically be cancelled at the end of the end of the membership term.  Billing services for FreeNetPass Annual are provided by ccbill.com or .

1. Surfer is at least 18 years old (or 21 in areas where 21 is the age of majority) at the time of acceptance of the FreeNetPass password.

2. With respect to sexually-explicit material contained on any pages accessed by the FreeNetPass password, Surfer acknowledges that, of his or her own free will, Surfer wishes to access such material and is not offended by graphic explicit displays of any sexual activity without limitation.

3. Surfer affirms that FreeNetPass cannot and will not be responsible for the content displayed by web pages that utilize the FreeNetPass password access system. Surfer acknowledges that FreeNetPass does not sponsor, produce, review, edit or in any way participate in any of the content of sites utilizing the password access services it provides. Any liability of FreeNetPass for such content, or claims made by web sites, is expressly disclaimed.

4. Surfer affirms that viewing of sexually explicit material does not break any laws nor conflict with community standards in the area wherein Surfer uses the FreeNetPass password, whether city, county, state, nation or territory.

5. Surfer shall not allow any other person or entity to know or use the password provided by FreeNetPass. Surfer shall solely incur damages and responsibilities for the improper, illegal, negligent or unauthorized use of the FreeNetPass password.

6. Surfer shall not copy or redistribute any copyrighted materials made available through the use of the FreeNetPass system to any other person or entity, nor violate the intellectual property rights of owners of accessed materials.

7. Surfer acknowledges and agrees that FreeNetPass does not endorse, sponsor, promote, or warrant any site that utilizes the FreeNetPass system. FreeNetPass only provides password access services and links to sites utilizing its services.

8. Surfer acknowledges that FreeNetPass is not responsible for any credit card or check billing issues.  Surfer agrees to contact the credit card billing company, CC Bill ( http://www.ccbill.com ) or for all billing inquiries.  

9. Surfer agrees to indemnify and hold harmless FreeNetPass for any damages, loss or claim, including costs and attorneys’ fees, caused by use or misuse of the FreeNetPass system or the knowledge of, possession or loss of possession of a FreeNetPass password. Surfer agrees to use the FreeNetPass system at his or her own risk.

10. FreeNetPass, at its sole discretion, reserves the right to refuse service to any person at any time. FreeNetPass reserves the right to revoke Surfer’s password at any time.

11. Surfer may only sign up for one password per calendar year.

12. Surfer agrees to periodically review this agreement, as posted on the FreeNetPass site, for amendments or changes made to the agreement by FreeNetPass. Changes are effective and become a part of this agreement as of the time that FreeNetPass posts the change on the site.

13. Surfer acknowledges and agrees that FreeNetPass is not responsible for any contact that Surfer may receive as a result of Surfer’s use of the FreeNetPass password or visitation of any site accessed by use of the FreeNetPass password, whether such contact is from cyberspace, telephonic, e-mail, snail mail, or personal, or in the form of advertising spamming, solicitation, recruitment or any other form of contact. Surfer understands that cyber travel involves risk from viruses, hacking and numerous other interactions that can cause damage to Surfer’s property. Surfer understands, acknowledges and agrees that FreeNetPass is not responsible for any damage caused to Surfer’s property when using the FreeNetPass password.

14. Surfer understands and acknowledges that FreeNetPass is an Internet traffic service provider that provides connection services for pages using FreeNetPass services to which Surfer voluntarily and, based solely on Surfer’s discretion, visits. FreeNetPass does not create, participate in, have any authority over or influence upon the pages.

15. In the event that any one or more of the provisions contained in this agreement shall for any reason be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision hereof, and this agreement shall be construed as if such invalid, illegal or unenforceable provision(s) had never been included.

16. Surfer agrees that this agreement shall be governed by and construed under the laws of the State of Minnesota without regard to conflicts of laws provisions thereof.

17. Surfer agrees that all disputes under this agreement shall be determined in the state courts of the State of Minnesota, and the parties hereto do hereby submit to the personal jurisdiction of such courts for purposes of determining matters related to this agreement.
