FreeNetPass End-User Agreement

This agreement for receiving a FreeNetPass password between you ("end-user") and Web Futures Ltd. ("FreeNetPass") is effective upon your acceptance until revoked by either party.

In consideration for being issued a FreeNetPass password, end-user acknowledges and agrees that all statements of fact set forth herein are true and correct, and that end-user’s use of the FreeNetPass password will at all times comply with the terms and conditions set forth below, including any changes or amendments made by FreeNetPass.

End-user agrees that any passwords obtained from FreeNetPass are for the sole use of the end-user and is not to be distributed in any way. Distribution will lead to cancellation of service and legal action where necessary.

End-user is at least 18 years old (or 21 in areas where 21 is the age of majority) at the time of acceptance of the FreeNetPass password.

With respect to sexually-explicit material contained on any pages accessed by the FreeNetPass password, end-user acknowledges that, of his or her own free will, end-user wishes to access such material and is not offended by graphic explicit displays of any sexual activity without limitation.

End-user affirms that FreeNetPass cannot and will not be responsible for the content displayed by web pages that utilize the FreeNetPass service. End-user acknowledges that FreeNetPass does not sponsor, produce, review, edit or in any way participate in any of the content of sites utilizing the password access services it provides. Any liability of FreeNetPass for such content, or claims made by web sites, is expressly disclaimed.

End-user affirms that viewing of sexually explicit material does not break any laws nor conflict with community standards in the area wherein end-user uses the FreeNetPass password, whether city, county, state, nation or territory.

End-user shall not allow any other person or entity to know or use the password provided by FreeNetPass. End-user shall solely incur damages and responsibilities for the improper, illegal, negligent or unauthorized use of the FreeNetPass password.

End-user shall not copy or redistribute any copyrighted materials made available through the use of the FreeNetPass system to any other person or entity, nor violate the intellectual property rights of owners of accessed materials.

End-user acknowledges and agrees that FreeNetPass does not endorse, sponsor, promote, or warrant any site that utilizes the FreeNetPass system. FreeNetPass only provides links to sites utilizing its services.

End-user agrees that in obtaining a FreeNetPass Free password, end-user may be offered access to a sponsoring web site. End-user acknoledges that purchases to any sponsoring web site are optional and at the sole discretion of end-user. Any such sponsoring web sites are not owned or operated by FreeNetPass. Further, such purchases are subject to the terms and conditions of the sponsoring web site. FreeNetPass has no control over any sponsoring web sites content and billing practices.  End-user agrees to contact the sponsoring web site and/or its billing company with all billing issues that may arise from end-users subscription to a sponsoring web site. FreeNetPass free passwords are good for 1 year and issued without charge. End-user has no purchase obligation to a sponsoring web site. Alternatively to receive your FreeNetPass Free password: Please send a self-addressed, stamped envelope along with a clear copy of your US Drivers license or international passport or other government issued Photo ID with address and birth date to: Membership Dept., Web Futures Ltd.  All submissions must be clearly visible and complete. Your username and password will be sent to the address on your ID (we cannot send to any other address). Please allow 8-10 weeks for processing.

End-user may only sign up for one Free password per calendar year. After 1 year, all Free passwords will automatically be cancelled. 

End-user agrees that in obtaining a FreeNetPass Premium password, they agree to pay in full, the amount listed at the time of signup for the membership option chosen (currently $24.95 per 1 month membership ).  The FreeNetPass Premium password subscription will automatically renew at the end of the initial membership term on a monthly basis at a cost of $24.95 per month (unless the membership is cancelled prior to the end of the current billing cycle).  Billing services for FreeNetPass Premium are provided by http://ccbill.com or http://www.epoch.com. End-user acknowledges that FreeNetPass is not responsible for any credit card or check billing issues.  End-user agrees to contact the credit card billing company, CC Bill ( http://www.ccbill.com ) or Epoch (http://www.epoch.com) for all billing inquiries.  

End-user agrees to indemnify and hold harmless FreeNetPass for any damages, loss or claim, including costs and attorneys’ fees, caused by use or misuse of the FreeNetPass system or the knowledge of, possession or loss of possession of a FreeNetPass password. End-user agrees to use the FreeNetPass system at his or her own risk.

End-user acknowledges and agrees that FreeNetPass is not responsible for any contact that end-user may receive as a result of end-user’s use of the FreeNetPass password or visitation of any site accessed by use of the FreeNetPass password, hether such contact is from cyberspace, telephone, e-mail, postal mail, or in person. End-user understands that cyber travel involves risk from computer viruses, theft of personal information, and numerous other interactions that can cause damage to end-user’s property. End-user understands, acknowledges, and agrees that FreeNetPass is in no way responsible for any damage caused to end-user’s property when using the FreeNetPass password.

End-user understands and acknowledges that FreeNetPass is an Internet traffic service provider that provides connection services for pages using FreeNetPass services to which end-user voluntarily and, based solely on end-user’s discretion, visits. FreeNetPass does not create, participate in, have any authority over or influence upon the pages.

FreeNetPass, at its sole discretion, reserves the right to refuse service to any person at any time. FreeNetPass reserves the right to revoke end-user’s password at any time. Any passwords issued are the sole property of FreeNetPass and must be relinquished on request.

End-user agrees to periodically review this agreement, as posted on the FreeNetPass site, for amendments or changes made to the agreement by FreeNetPass. Changes are effective and become a part of this agreement as of the time that FreeNetPass posts the change on the site.

In the event that any one or more of the provisions contained in this agreement shall for any reason be held to be invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision hereof, and this agreement shall be construed as if such invalid, illegal or unenforceable provision(s) had never been included.

End-user agrees that this agreement shall be governed by and construed under the laws of the United Kingdom without regard to conflicts of laws provisions thereof.

End-user agrees that all disputes under this agreement shall be determined in the courts of the United Kingdom and the parties hereto do hereby submit to the personal jurisdiction of such courts for purposes of determining matters related to this agreement.
